BOX 1108 <br /> tgg E(0 MASHPEE, MA 02649 <br /> DEICISON <br /> RE: Petition of John Sullivan for a Variance Case #V-87-05-050 <br /> A Petition for a Variance was filed by John Sullivan of Mashpee, <br /> Massachusetts for a variance from the provisions of Section 11A of the <br /> zoning By-Law to construct a house within 100 feet of the Mashpee River. <br /> Locus is Lot 15 shown on a subdivision plan approved by the Mashpee Plann- <br /> ing Board over twenty years ago. This lot borders the Mashpee River and <br /> a portion of it is located in the Mashpee River Protective District with <br /> the remaining portion being located in the Residential 3M District. <br /> The Mashpee River at this location is very shallow. It is approxi- <br /> mately 12 inches deep. It is a fish run for alewives and brook trout and <br /> has received Conservation attention from the Town over many years. This <br /> particular location has been the subject matter of Conservation Commission <br /> and D.E.Q.E. intervention due to siltation of the River caused by erosion <br /> from Lots 14 & 15. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of generaP circulation in the Town of Mashpee on <br /> i <br /> May 13, 1987 and May 20, 1987, a copy which is attached hereto and made <br /> a part hereof. <br /> A public hearing was held on May 27, 1987 at which time the following <br /> members of the Board of Appeals were present and acting throughout: Michael <br /> Makunas, William Hanrahan and Thomas Sexton. <br />
