SANDCASTLE MASHPEE, INC. - SPECIAL PERMIT <br /> The undersigned members of the Mashpee Planning Board <br /> hereby adopt the following modifications to the Special Permit <br /> decision issued on April 22 , 1987 and recorded with the <br /> Barnstable County Registry of Deeds in Book 5734 , Page 233 . <br /> FINDING 8 - PAGE 5 is modified by inserting in <br /> place thereof the following: <br /> 118 . The parking of vehicles as shown on the site <br /> plan approved on April 22, 1987 , shall be <br /> specifically allowed. The Board finds that <br /> because of the importance of the buffer zone and <br /> the protection of the Mashpee River a waiver of <br /> parking requirements set forth in Section 8 . 6 of <br /> the Zoning By-Law may be required and, if so, the <br /> Board is in favor of such a waiver . " <br /> CONDITION 10 - PAGE 8 is modified by inserting <br /> in place thereof the following: <br /> 1110 . That the waiver of the parking requirements <br /> of Section 8 . 6 of the Zoning By-law in finding 8 <br /> hereof shall be contingent upon an opinion of Town <br /> Counsel allowing said waiver , or , in the <br /> alternative, that a variance from said requirement <br /> be obtained from the Mashpee Zoning Board of <br /> Appeals . However , if the Building Inspector <br /> determines that the entire Open Space Plan dated <br /> April 22, 1987 meets the requirements of Section <br /> 8 . 6 (as evidenced by the initial issuance of <br /> building permits for the first phase of <br /> construction) , then no opinion of Town Counsel or <br /> variance will be required since no waiver is <br /> necessary.
