BOX 1108 <br /> MASHPEE, MA 02649 <br /> DECISION <br /> RE: Petition of Jomar, Inc. for a Variance Case #V-87-11-112 <br /> A Petition was filed by Jomar, Inc. of Mashpee, Massachusetts for <br /> a Variance for permission to construct a dwelling within 50 feet of <br /> the wetlands and to build within 25 feet of the A.C.E.C. district in <br /> a R-3 Zoning District on property located on lot 3 Tide Run, (map 126, <br /> parcel 43) , Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> October 26 & November 2, 1987, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, November 10, 1987 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William Hanrahan, Michael Makunas and Edward Govoni. <br /> Recommendations were received from the Mashpee Conservation Commission. <br /> The Board ascertained the hardship would be the topography of the lot. <br /> Upon motion duly made and seconded the Board of Appeals voted unani- <br /> mously on December 9, 1987 to grant permission to build within the A.C.E.C. <br /> district and to grant a Variance to build within 34 feet of the wetlands <br /> with the stipulation this Applicant comply with all "Orders of Conditions" <br /> setforth by the Mashpee Conservation Commission. This Variance is refer- <br /> enced to plan #513287 on file. <br />
