BOX 1108 MASHPEE, MA 02649 DECISION RE: Petition of Jomar, Inc. for a Variance Case #V-87-11-112 A Petition was filed by Jomar, Inc. of Mashpee, Massachusetts for a Variance for permission to construct a dwelling within 50 feet of the wetlands and to build within 25 feet of the A.C.E.C. district in a R-3 Zoning District on property located on lot 3 Tide Run, (map 126, parcel 43) , Mashpee, Massachusetts. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in the Falmouth Enterprise, a newspaper of general circulation in the Town of Mashpee on October 26 & November 2, 1987, a copy of which is attached hereto and made a part hereof. A public hearing was held on the petition at the Mashpee Town Hall on Wednesday, November 10, 1987 at 7:30 p.m. at which time the following members of the Board of Appeals were present and acting throughout: William Hanrahan, Michael Makunas and Edward Govoni. Recommendations were received from the Mashpee Conservation Commission. The Board ascertained the hardship would be the topography of the lot. Upon motion duly made and seconded the Board of Appeals voted unani- mously on December 9, 1987 to grant permission to build within the A.C.E.C. district and to grant a Variance to build within 34 feet of the wetlands with the stipulation this Applicant comply with all "Orders of Conditions" setforth by the Mashpee Conservation Commission.
