Costa of Decision of Mashpee Building Department <br /> Case #NOA-88-04-029 <br /> An appeal was filed by -Manuel J. Costa of Mashpee, Massachusetts <br /> from a decision of the building department dated January 26, 1988 in which <br /> the applicant was cited for violations under Section 6 of the Mashpee <br /> Zoning By-Laws on property lcoated on 31 South Sandwich Road, (map 16, <br /> parcel 94) , Mashpee, Massachusetts. <br /> Notice of applicant's appeal was duly given to abutters in accordance <br /> with Massachusetts General Laws Chapter 4OA. Notice was given by publica- <br /> tion in the Falmouth Enterprise, a newspaper of general circulation in the <br /> Town of Mashpee on March 30 & April 6, 1988, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, April 13 & 27, 1988 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: William <br /> Hanrahan, Michael Makunas and Richard Halpern. <br /> Counsel , representing the applicant, informed the Board that the <br /> applicant' s use of the premises is a protected pre-existing non-conforming <br /> use under Massachusetts Zoning By-Laws section 5. 1 and as such, may be con- <br /> tinued notwithstanding the decision of the building deparmtnet. The Board <br /> was presented with ample evidence that applicant' s oil delivery business <br />
