MA 02649 <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Ricci Homes for a Variance Case #V-88-05-036 (owner on record; <br /> Robert J. Cunningham) <br /> A petition was filed by- Ricci Homes of East Sandwich, Massachusetts <br /> for a Variance for permission to vary the sideline setback requirements <br /> in a R-3 Zoning District on property located on lot 38 Bogs River Bend, <br /> (map 86, parcel 15) , Mashpee Massachusetts. <br /> Notice was duly givne to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> April 27 & May 4, 1988, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, May 11 , 1988 at 7:30 p.m. at which time the following mem- <br /> bers of the Board of Appeals were present and acting throughout: William <br /> Hanrahan, Michael Makunas and Edward Govoni . <br /> The Board was informed that due to an engineering error the founda- <br /> tion for the garage was poured in violation of the sideline setback regula- <br /> tions. The Board ascertained the hardship was not self-imposed. <br /> Upon motion duly made and seconded the Board of Appeals voted unani- <br /> mously on May 11 , 1988 to grant the sideline setback Variance of 1 .6 feet <br /> as requested. <br />
