MA 02649 <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Petition of Thomas Staruch and Robert F. Mills Case: V-88-06-051 <br /> A Petition was filed by Thomas Staruch and Robert F. Mills of Mashpee, <br /> Massachusetts for Variance under Sections 7.1 and 7.5 of the Land Space <br /> Requirements for the extension of a non-conforming use on property <br /> located at Lot 40B Cotuit Road (Map 29, Lot 40) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on July 27 and August 3, 1988, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, August 10, 1988 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl Hawver, Richard Halpern and Edward Govoni. <br /> The Board was informed that the owners had purchased one lot on <br /> Cotuit Road which contained two houses. They have received Planning <br /> Board approval to divide the land into two lots. The house on Lot B <br /> is in poor condition and the owners would like to have it demolished <br /> and to rebuild on the lot. They are seeking the Variance to insure the <br /> lot retains its buildability if the house is torn down. <br /> Douglas Boyd, Building Inspector, and Randolph Peters, an abutter, <br /> confirmed the deterioration of the structure. <br /> The Board determined that there were circumstances which especially <br /> affect the structure in question but which do not affect generally the <br /> zoning district in which the structure is located. Due to these circumstances <br /> the literal enforcement of the zoning by-law would create a hardship. <br /> L <br />
