Terry for a Special Permit Case #SP-88-03-023 <br /> (owner on record; Hamilton and Bertha Mack) <br /> A Petition was filed by Robert E. Terry of East Sandwich, Massachusetts <br /> for a Special Permit for permission to extend two, 6 unit buildings in a <br /> R-3 Zoning District on property located on DeGrasse Road, (map 103, parcel <br /> 5) , Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> February 24 & March 2, 1988, a copy of which is attached hereto and made <br /> a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, March 9, 1988 at 7:30 p.m. at which time the following members <br /> of the Board of Appeals were present and acting throughout: Michael Makunas, <br /> Edward Govoni and Richard Halpern. <br /> Concerns were raised from abutters regarding the possible contamina- <br /> tion of the ground water supply from the leaching system. The Design Review <br /> Committee did not forward their approval for this project. The Board ascer- <br /> tained this project was not standard or typical to the neighborhood. Questions <br /> were raised as to the intensification of this pre-existing non-conforming use. <br /> Information was received that the abandonment of the non-conforming usage <br /> exceeded the twenty-four month requirements. <br />
