Barbara Mulloney for a Special Permit <br /> Case: SP-89-01-13 <br /> A Petition was filed on January 11, 1989 by A. Barbara Mulloney <br /> (a.k.a. A. Barbara Porter) of Mashpee, Massachusetts for a Special <br /> Permit to extend pre-existing non-conforming use in an R-3 zoning <br /> district on property located at 26 Nick Trail (Map 117, Lot 247) <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the <br /> Falmouth Enterprise, a newspaper of general circulation in the Town <br /> of Mashpee, on February 8 and February 15, 1989. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, February 22, 1989 at which time the following members of <br /> the Board of Appeals were present and acting throughout: William Hanrahan, <br /> Michael Makunas and Richard Halpern. <br /> The Board was informed that the applicant proposes to replace a <br /> summer cottage with a year-round home. The new home will have the same <br /> foundation size as the present structure and will be less non-conforming <br /> than the cottage due to a reduction in size of roof overhang. <br /> The Board determined that the use is in harmony with other permitted <br /> .uses in this zoning district and the change would not be more detrimental <br /> than the existing condition. Upon motion duly made and seconded the <br /> Board of Appeals voted unanimously on February 22, 1989 to grant the <br /> Special Permit as requested. The Board established that granting this <br /> Special Permit would be in harmony with the general purpose and intent <br /> of the ordinance or by-law and would be an improvement to the surrounding <br /> neighborhood. <br />
