BOX 1108
P MASHPEE, MA 02649
RE: Petition of William Sullivan for a Variance
Case: V-89-01-16
A Petition was filed on January 13, 1989 by William Sullivan
of Providence, Rhode Island, for a Variance for permission to vary
the front-line setback and permission to construct a pool within
50 feet of the wetlands in an R-3 zoning district on property located
at 6 Daniel's Island Road (Map 100, Lot 18) Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in the
Falmouth Enterprise, a newspaper of general circulation in the Town
of Mashpee on February 8 and February 15, 1989, a copy of which is
attached and made a part hereof.
A public hearing was held on the petition at the Mashpee Town
Hall on Wednesday, February 22, 1989 at 7:30 p.m, at which time the
following members of the Board of Appeals were present and acting
throughout: William J. Hanrahan, Michael A: Makunas and Richard E.
Halpern.
The Board was informed that the owners plan to expand a garage
and improve access to it requiring a reduction in the front-line
setback from the present 18' to 14' . They also propose to install a
pool at the rear of the property.
The Board determined that the shape of the lot created a
hardship and there were no alternative locations to expand the
garage. The Board found that this variance request will not
derogate from the intent of the by-laws and would not be a
detriment to the surrounding neighborhood.
No comments were received from the Conservation Commission.
