MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Petition of Caroline Dunivan for a Special Permit <br /> Case: SP-89-02-17 <br /> A Petition was filed on February 2, 1989 by Caroline Dunivan of <br /> Mashpee, Massachusetts for a Special Permit under the conditions of <br /> Fields Point Corporation Special Permit No. SP-86-04-024 for permission <br /> to operate a breakfast .and lunch restaurant in Space 7.5A of Mashpee <br /> Commons in a C-1 zoning district on property located on Route 28 and <br /> Route 151 (Map 74, Lot 20) Mashpee, MA. (Owner of Record: Fields <br /> Point Limited Partnership) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on February 22 and March 1, 1989. _ <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, March 8, 1989 at which time the following members of the <br /> Board of Appeals were present and acting throughout: Cheryl Hawver, <br /> Michael Makunas and Edward Govoni. <br /> Mr. John Renz of Fields Point Limited Partnership represented <br /> the petition. He reviewed plans to convert space formerly used for <br /> retail sales to a breakfast and lunch restaurant. Design Review <br /> Committee had approved the plans for renovation. <br /> The Board determined that the use was in harmony with the general <br /> purpose and intent of the zoning by-laws and complies with the specific <br /> provisions of the by-laws <br />
