MA 02649 BOARD OF APPEALS DECISION FOR MODIFICATION OF A SPECIAL PERMIT t RE: Petition of Bonwood Company for a Modification of a Special Permit - SP-89-10-97 This matter was brought before the Board of Appeals of the Town of Mashpee by Bonwood Co. , Inc. (Owner of record- Reliance Development Corp.) owner of 264.41 acres of land located north of Route 151 and west of Old Barnstable Road, and partly bounded on the west by Algonquin Road and on the north by Payamps Road. Said land is shown as Lot 35 on Mashpee Assessor's Map 65. The Petitioner seeks to modify Paragraph 3 of "Decision of the Board of Appeals on Petition to Modify Special Permit," dated January 29, 1985 to clarify the meaning of the term "in any one year" as used therein. The Petitioner also seeks a modification of Paragraph 7, to refine and adjust the construction schedule as it relates to the issuance of occupancy permits. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Enterprise, a newspaper of general circulation in the Town of Mashpee on October 23, 1989 and October 30, 1989, a copy of which is attached hereto and made a part hereof. A public hearing was held on the Petition at the Mashpee Town Hall on Wednesday, November 8, 1989 at 7:30 p.m. at which time the following members of the Board of Appeals were present and acting throughout: Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. Attorney Michael Dunning represented the applicant. He informed the Board that the Petitioner seeks to clarify Paragraph 3 of the Decision, which presently reads: "No more than 100 dwelling units may be granted Certificates of Occupancy in any one year."
