MA 02649 <br /> BOARD OF APPEALS <br /> DECISION FOR MODIFICATION <br /> OF A SPECIAL PERMIT <br /> t RE: Petition of Bonwood Company for a Modification of a <br /> Special Permit - SP-89-10-97 <br /> This matter was brought before the Board of Appeals of the Town <br /> of Mashpee by Bonwood Co. , Inc. (Owner of record- Reliance Development <br /> Corp.) owner of 264.41 acres of land located north of Route 151 and <br /> west of Old Barnstable Road, and partly bounded on the west by Algonquin <br /> Road and on the north by Payamps Road. Said land is shown as Lot 35 <br /> on Mashpee Assessor's Map 65. The Petitioner seeks to modify Paragraph <br /> 3 of "Decision of the Board of Appeals on Petition to Modify Special <br /> Permit," dated January 29, 1985 to clarify the meaning of the term <br /> "in any one year" as used therein. The Petitioner also seeks a <br /> modification of Paragraph 7, to refine and adjust the construction <br /> schedule as it relates to the issuance of occupancy permits. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on October 23, 1989 and October 30, 1989, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, November 8, 1989 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and William J. <br /> Hanrahan. <br /> Attorney Michael Dunning represented the applicant. He informed <br /> the Board that the Petitioner seeks to clarify Paragraph 3 of the <br /> Decision, which presently reads: "No more than 100 dwelling units <br /> may be granted Certificates of Occupancy in any one year." <br />
