Board of Appeals Bonwood Co. SP-89-10-97 Page 3. i Upon motion duly made and seconded, the Board of Appeals voted unanimously on November 8, 1989 to modify the Special Permit as follows: 1. to amend Paragraph 3 so that it shall read as follows: "3. No more than 100 dwelling units may be granted Certificates of Occupancy in any one calendar year." 2. to amend Paragraph 7 so that it shall read as follows: j "7. The water system for the first fifty units of Phase I, as shown on plan by E. J. Flynn Engineers entitled Pine Hill Estates, Phase IA, dated September 24, 1986, revised January 5, 1989, attached hereto and made a part hereof, must be completed and substantial work must be commenced on the sewer system plant, amenity center, swimming pools, tennis courts and golf course prior to the issuance of the first Occupancy Certificate for any dwelling unit; the sewer system plant, the amenity center, swimming pools and tennis courts must be completed prior to the issuance of the 51st Occupancy Certificate. The amenity center, swimming pools and tennis courts must be completed before March 30, 1990 and if not able to be completed by this date due to adverse weather conditions applicant may apply for an extension for an additional 90 days. 3. The Board finds that based on aerial photos, site inspection and architectural certification, that there has been substantial work commenced as required in Section 2. 4. - Certificates of Occupancy issued prior to the completion of the amenities will require a Notice of Release to the Town of Mashpee signed by the prospective purchaser in the form attached hereto as approved by Town Counsel and filed with the Building inspector. 5. All conditions of the Modification of Special Permit filed January 29, 1985 remain in effect subject to the Modifications filed January 28, 1988, March 10, 1988, September 21, 1988 and October 14, 1988.
