MA 02649
BOARD OF APPEALS
DECISION
FOR A VARIANCE
RE: Stanley Siskind for a Variance V-89-10-96
A Petition was filed by Stanley Siskind of South Easton, Massachusetts
for a Variance for permission to vary the lot coverage in an R-3 zoning
district on property located at 19 Driftwood Circle (Map 125, Block 200)
Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee,
on November 13 and November 20, 1989, a copy of which is attached hereto
and made a part hereof.
A public hearing was held on the Petition at the Mashpee Town Hall
on Wednesday, November 29, 1989 at 7:30 p.m. at which time the following
members of the Board of Appeals were present and acting throughout:
Michael A. Makunas, William J. Hanrahan and John J. Friel.
Mark Marinaccio, Architect, represented the application. He asked
the Board for a modification of the application to change the size of
the addition from 15' x 15' to 15' x 20' . There were no objections.
Mr. Marinaccio explained that the addition would connect the house with
the garage and would result in lot coverage of 21.97. The Board
determined that the shape of the lot created a hardship and that there
were circumstances relating to this lot which did not affect generally
the zoning district in which the land was located. The Board established
that granting this Variance would be in harmony with the general purpose and
intent of the by-laws and would not be a detriment to the surrounding
neighborhood.
