r <br />Mashpee Board of Appeals . Minutes - August 23, 1989 Page 3. <br />Robert Sherman, Conservation Agent, presented the Board with written <br />objections to the application and read the comments to the Board. He said <br />the comments addressed both the Silver petition and the R. 6 M. Realty <br />Trust petition to be heard later in the meeting. He said the structures <br />in question are over twice the allowable length.and that the pilings <br />• would result in in a total area of marsh destroyed/disturbed in excess <br />of the footprints of the pilings themselves since root systems would be <br />disrupted. The memo reviewed the values of the saltmarsh. <br />John Slavinsky stated that he considered the important point was <br />"substantial disruption" of the marine or coastal environment. The <br />project would require 14 square feet of pilings as agreed to by the <br />Conservation Commission. He said the Board of Appeals has to determine <br />if 14 square feet is a "substantial detriment". <br />Mr. Dubin commented that a lot of thought when into the concerns of <br />the Shellfish and Conservation Commission but that the legal question <br />of the authority of the Board to grant a variance is most important. <br />He requested a continued hearing to allow time for research on the <br />issue. <br />Mr. Hanrahan requested that if a continued hearing is held that <br />Mr. Dubin give the Board an extension on the time calendar of the <br />application. <br />Mr. Hanrahan moved to grant a continuance. Mr. Makunas stated <br />• that he would argue against continuance. Mr. Hanrahan responded that <br />he did not feel that this petition should be taken under advisement <br />and Ms. Hawver agreed. <br />Mr. Hanrahan moved to continue to September 27, 1989. Ms. Hawver <br />• seconded. All agreed. <br />Mr. Makunas asked Mr. Slavinsky for an estimate of engineering <br />costs for dock applications. Mr. Slavinsky replied that the cost was <br />approximately $1,500 to get to the presentation of plans to the <br />Conservation Commission for an order of conditions. <br />R. 6 M. Realty Trust -(Owners of record: Richard S. Dubin and <br />Marshall M. Dranetz) - Request a Special Permit under Section 6.3.I.9 <br />of the Land Use Regulations for permission to construct a walkway in <br />an R-3 zoning district on property located at 69 S. Waterline Drive <br />(Map 120, Block 142; Map 120, Block 140A) Mashpee, MA. <br />R. 5 M. Realty Trust - (Owners of record: Richard S. Dubin and <br />Marshall M. Dranetz) - Request a Variance under Section 7.4 of the <br />Land Space Requirements and Section 6.3.I.9 of the Land Use Regulations <br />to allow a zero setback from the rear property line and to exceed the <br />walkway length of 70 feet in an R-3 zoning district on property located <br />at 69 S. Waterline Drive (Map 120, Block 142; Map 120, Block 140A) <br />Mashpee, MA. <br />• <br />• <br />
