Board of Appeals November 8, 1989 Page 3. <br />Walter Yaroush, Architect of Southport, explained that all manpower at the <br />is <br />site is being directed to completion of the units which have been sold. <br />George Costa, Chairman of the Board of Health, stated that Bonwood has <br />gone to great expense for the treatment plant and confirmed that it would <br />not operate with a certain amount of initial flow. He said other develop- <br />ments have had interim systems and that the Board of Health had no <br />objections and would work with them on insurance and bonding. <br />Comments were received from two contractors stating that their firms had <br />been paid. Michael Roberts, forement of the general framing contractor, <br />said it was customary to have a hold -back of some of the payment to the <br />sub -contractors until the work was proven satisfactory. <br />Mr. Makunas explained that paragraph 7 had been included in the original <br />permit to protect the people who were purchasing units. He asked for <br />comments from prospective owners and asked for a show of hands from the <br />audience of those who had purchased units. <br />An unidentified member of the audience asked if there was going to be bond <br />to protect the owners and insure that the work would be done. <br />Mr. Yaroush responded that the bank had required them to detail every item <br />in the project. The money for the amenity complex cannot be used for <br />anything else. <br />• Ron Bonvie of the Bonwood Co. said that there was $1,600,009 left for the <br />completion of the amenity center. <br />Mr. Hanrahan said he wanted to protect the people who are investing in <br />the units and also proect the Town. <br />Douglas S. Boyd, Building Inspector said it might be possible that each <br />owner sign a release for the Town. Mr. Hanrahan suggested a finite date <br />for completion. <br />Mr. Makunas asked that if 50 occupancy permits were issued would the amenities <br />be completed before application for the 51st occupancy permit. <br />Mr. Yaroush said they would expect completion by March 30, 1990. Mr. Bonvie <br />said the parking lot completion would be a problem if there were heavy <br />spring rains. Mr. Makunas asked if the golf course would be completed <br />before the 101st occupancy and Mr. Bonvie responded that they were ahead <br />of schedule on the course. <br />Frances Brubeck, an owner, asked if construction will continue in buildings <br />where only one unit is sold. Mr. Bonvie replied that the total building <br />has to be completed to the plaster stage and finished on the outside. This <br />is required by the building codes. <br />Mr. Hanrahan asked Mr. Boyd's opinion on the carryover of unused occupancy <br />• permits. Mr. Boyd said he did not think they should be allowed. He <br />thought there should be no more than 100 occupancies in a year. <br />Mr. Makunas stated that he had sat on the Board of Appeals for the original <br />January, 1985 permit and the intent of restricting occupancy permits was <br />to prevent impact on Town services. <br />
