Board of Appeals Minutes - February 14, 1990 <br />Page S. <br />• Mr. Fitch: Oh, yes. This is not meant to circumvent any regulations <br />or procedures that are required for the approval of the <br />plan. It is simply to be able to go back and pick up <br />legally where we left off finding ourselves illegal. <br />Margaret Carmichael, an abutter, asked about the traffic study done <br />on Pimlico Pond Road before the Bornstein development. Mr. Ferragamo <br />responded that it was one more reason to fix the curve. Mr. Boyd said <br />that there is a $100,000 payment that was supposed to be paid by Larry <br />Nicklus to have the road improved. <br />Ms. McCaffrey asked why the plan was not filed on time and Mr. Fitch <br />responded that it was unusual when he filed with the Planning Board to be <br />asked to go to a separate agency in the Town and get something done before <br />the Planning Board would consider it. <br />There was discussion of the number of bedrooms per lot and Mr. Makunas <br />explained that the Board of Health has jurisdiction on septic systems and <br />restrictions on bedrooms and baths. <br />Mr. Ferragamo said that there was not a concensus among the Planning <br />Board members that there was a clearly recofnized advantage in going from <br />a 60,000 sf to an 80,000 sf minimum lot size. <br />Mr. Hanrahan moved to take the application under advisement. Mr. Halpern <br />• seconded. All agreed. <br />John W. Finn - (Owner of record: George T. and Jean A. O'Donnell) <br />Requests a Special Permit under Section 174-17 of the Zoning By-laws for <br />permission to expand a non -conforming structure with a 12' x 12' addition <br />on property located in an R -S zoning district at 27 Horseshoe Bend Way <br />(Map 48, Block 9) Mashpee, MA. <br />Members sitting: M. Makunas, W. Hanrahan, E. Govoni <br />John Finn presented plans for a bedroom addition and half bath. He <br />explained that the house had been built in 1940 and a deck added since then. <br />Mr. Makunas explained that the Board would have to know what now exists on <br />the lot and that the wood deck may be in violation of zoning. <br />Mr. Hanrahan stated that the deck is part of the present structure <br />and would have to be included in the computation of lot coverage. <br />Mr. Makunas suggested that the Applicant return for the February 28, 1990 <br />meeting with lot coverage percentage and substantiate the age of the deck <br />which establishes the side -line setback. <br />Mr. Govoni explained that some of the deck area may have to be <br />removed and that a Variance may be needed. <br />Mr. Hanrahan moved to take the application under advisement. <br />It Mr. Govoni seconded. All agreed. Mr. Finn was asked to return at <br />the February 28, 1990 with the required information. <br />Mr. Hanrahan stepped down from the Board and left the room for <br />the next hearing. <br />
