I
a
P. O. BOX 1108
RLE N' MASHPEE. MA 02649
BOARD OF APPEALS
DECISION
FOR A VARIANCE
RE: Mark Eynatian for a Variance V-90-85
A Petition was filed by Mark Eynation of Chelmsford, Massachusetts
for a Variance under Section 174-31 of the Zoning By-laws for permission
to vary the set back and lot coverage requirements in an R-3 zoning
district on property located at 51 Uncle Edwards Road (Map 117,
Block 221) Mashpee, Massachusetts. (Owner of record: B. Kenneth and
Ruth H. Eynation) .
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee,
on October 29 and November 5, 1990, a copy of which is attached hereto
and made a part hereof.
A public hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, November 14, 1990 at 7:30 P.M. at which time the
following members of the Board of Appeals were present and acting
throughout: Cheryl A. Hawver, Michael A. Makunas and William J.
Hanrahan.
Engineer David Sanicki represented the applicant and presented
plans for a proposed home at the corner of Uncle Edward's Road
and Westwood Road, a paper road. He requested a Variance to allow
a 25' set back from Uncle Edward's Road, a 15' setback from Westwood
Road and 22.3% lot coverage. Comments were received from abutters
objecting to the size of the house and the applicant was advised to
revise the plans and review them with the direct abutters. Revised
plans were received at the meeting of January 9, 1991 which reduced
the lot coverage to 19.8% and letters were received from the abutters
in favor of the application.
