MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Bosun's Marine V-90-88 <br /> A Petition was filed by Bosun's Marine for a Variance from Section <br /> 174-31 of the Zoning By-laws for permission to vary the setbacks in <br /> a C-2 zoning district on property located at 7 Bowdoin Road <br /> (Map 54, Block 6 ) Mashpee, MA. (Owner of record: Wayne R. Tavares) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on October 29, 1990 and November 5, 1990, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, November 14, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. <br /> Timothy Leedham represented the application. He informed the Board <br /> that he was planning to operate a business for the.sale of marine supplies <br /> and boats on the site of Heritage Gardens. The property had received <br /> a Variance in 1986 from the setback requirements on the north and east <br /> property line. He explained that the current application is to permit <br /> rearrangement of the east side parking spaces and connect this area <br /> to the north side parking. He informed the Board that the new plan <br /> would facilitate the access to fire equipment to the buildings and <br /> improve the circulation of traffic at the site. The plans have <br /> received the approval of the Design Review Committee. <br /> The Board found that there were circumstances relating to the <br /> land in question which did not affect generally the zoning district <br /> and a literal enforcement of the by-laws would involve hardship. The <br /> Board determined that relief could be granted without derogating from <br /> the intent of the by-law or without detriment to the public good. <br />
