MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> A Petition was filed by Louis Marandola of Mashpee, Massachusetts <br /> for a Special Permit under Section 174.2.5.H. 13 of the Zoning By-laws <br /> to allow for the temporary sale of Christmas trees and wreaths in a <br /> C-1 zoning district on property located at 650 Falmouth Road (Route 28) <br /> Map 81, Block 4) Mashpee, Massachusetts. (Owner of record: Charles M. <br /> Talanian, TR) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise,, a newspaper of general circulation in the Town of Mashpee, <br /> on November 12 and November 19, 1990, a copy of which is attached hereto <br /> and made. a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, November 28, 1990 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Michael A. Makunas, John J. Friel and B. Thomas Christian. <br /> Mr. Marandola informed the Board that he was seeking a permit to <br /> sell Christmas trees and wreaths from December 1, 1990 to December 24, 1990. <br /> He said this will be the only activity on the property since the flea <br /> market and Fabio's restaurant have closed for the season. <br /> The Board established that granting this Special Permit would be <br /> in harmony with the provisions of the By-laws and would not be a <br /> detriment to the neighborhood. The Board required that the permit <br /> would be for the period December 1 to December 27, 1990 only and that <br /> all trees and wreaths be removed from the site by December 27, 1990. <br />
