Board of Appeals Minutes -January 8, 1997 2. <br /> Mr. Govoni explained that the Board is concerned with the total parking within the <br /> complex. Ms. Bold reviewed the plans and explained that some of the spaces were <br /> located on an easement. Mr. Govoni said he would like information on whether there <br /> would be adequate parking if the parking on the easement were eliminated. Deputy Chief <br /> Hamblin questioned if there was a daycare center they would need a sprinkler system. Mr. <br /> Cappozolli said it was not a daycare center but a baby sitting area. <br /> Mr. Govoni moved to continue to February 12. Mr. Regan seconded. All agreed. <br /> Deer Crossing Associates -Italian Market -Request a Special Permit under Sections 174- <br /> 518, 174-25.E.2, 174-25.H.6 and 174-17 to allow two signs exceeding 20 square feet <br /> each, continued use of a pre-existing sign, a sign less than 20 square feet on the back wall, <br /> a menu board and an awning over a drive-through window. The applicant also seeks a <br /> Special Permit to operate a drive-through window for food and beverage service on <br /> property located in a C-1 zoning district at 681 Falmouth Road(Map 81, Block 23) <br /> Mashpee, MA. <br /> Members sitting: E. Govoni, J. Regan, R. Nelson <br /> Attorney Robert Mills represented the applicant and asked that the applicant be changed <br /> to L.L.R.C., Inc. He asked to withdraw without prejudice the application for the sign on <br /> the back wall, a menu board, drive through window and an awning over the drive through <br /> window. He said he was applying only fora Special Permit for two signs exceeding 20 <br /> square feet each. <br /> Mr. Govoni questioned if the Selectmen would be the authority for the drive through <br /> window since the store sold alcoholic beverages. Mr. Hauck confirmed that the <br /> Selectmen would have to approve it. Attorney Mills said he would proceed under the old <br /> sign by-laws-since the Attorney General had not approved the revised by-laws. He said <br /> the signs are currently on the building and do not exceed the allowed percentage of wall <br /> space but do exceed 20 square feet. <br /> Mr. Regan questioned sign violations with use of banners and neon signs. Mr. Mills <br /> explained that the market had a permit for the holiday banner. Comments were received <br /> from abutters regarding the excess of the signs on the property and the lawsuit. <br /> Mr. Regan moved to grant the withdrawal without prejudice of the application for a drive <br /> through window, signs on the menu board and back of the building and the awning over <br /> the window. Mr. Regan seconded. All agreed. Mr. Regan moved to grant the Special <br /> Permit for two signs exceeding 20 square feet each. Mr. Nelson seconded. All agreed. <br /> ,r Q <br />
