Trust/ Susan Fort TRS. -Requests a Special Permit under Section 174-25.I.9 of the
Zoning By-laws for the construction of a pier, ramp and float on property located in an R-
3 zoning district at 78 Spoondrift Way(Map 112, Block 43)Mashpee, MA.
Members sitting: E. Govoni, J. Regan, C. Hawver
Engineer David Sanicki represented the applicant and reviewed plans for a proposed dock
which has been approved by Conservation. He explained that Conservation has asked for
some additional erosion control which is not involved in the application before the Board.
The Harbormaster has approved the location.
Ms. Hawver moved to grant the 32' Variance to allow for a 102' dock. Mr. Regan
seconded. All agreed. Ms. Hawver moved to grant the Special Permit under Section 174-
25.1.9. Mr. Regan seconded. All agreed.
Howard Glaser -Requests a Variance from Sections 174-31 and 174-33 of the Zoning
By-laws for permission to vary the front and side setback requirements and to allow
construction of a single family home 36.5 feet from the edge of the wetlands on property
located in an R-3 zoning district at 1 Tide Run(Map 126, Block 45)Mashpee, MA.
(Owner of record: Christopher Burden TR.)
Members sitting: E. Govoni, I Regan, C. Hawver
Mr. Regan stated that this was a Chapter 112 hearing since taxes were owed on the
property.
Engineer Michael Grotzke represented the applicant and presented a plan of the lot with
the layout of the proposed house. The plan also delineated the possible location of a
house which would not require a variance. He explained that the Conservation
Commission had approved the location of the house 35' from the wetlands instead of the
50' of the By-law. The applicant was also requesting a 5' variance in the sideline setback.
Mr. Govoni said that the Board had received 50 letters in opposition to the application.
He read a letter from the Director of Public Works opposing the granting of the front
setback. He also read a letter from the Little Neck Bay Association opposing the
application. Mr. Grotzke noted that the Little Neck Bay Association had misunderstood
the dimensions of the Variances requested.
