Board of Appeals Minutes -February 12, 1997 2. <br /> Mr. Makunas moved to grant the permit. Ms. Hawver seconded. All agreed. The Board <br /> found that the addition conforms to the setback requirements and lot coverage <br /> requirements and would not be a detriment to the neighborhood. <br /> Eleanor J. Vanaria- Requests a Variance from Sections 174-21 and 174-31 of the Zoning <br /> By-laws for permission to vary the lot size and frontage requirements to allow the <br /> construction of a new single family dwelling in an R-3 zoning district on property located <br /> at 15 Jeep Place(Map 118, Block 113) Mashpee, MA. <br /> Members sitting: E. Govoni, C. Hawver, M. Makunas <br /> Engineer John Slavinsky represented the applicant and presented the original plan of the <br /> Popponesset lots and explained that the subject lot is larger than any on the plan. He said <br /> the lot is assessed at $153,000 and taxes have been paid since early 50's. Mr. Govoni <br /> asked if the lot was in common ownership with adjoining lots. Mr. Hauck explained that <br /> it was and became non-conforming in 1971. Mr. Govoni explained that zoning was <br /> changed in 1990 which eliminated the protection of non-conforming lots in common <br /> ownership. He said the Board cannot grant a Variance because of the zoning change. A <br /> memo was received from Mr. Hauck confirming the common ownership. Mr. Govoni <br /> explained that the Board had tried to submit an article for Town Meeting to grant relief <br /> but this had not been placed on the warrant. <br /> Ken Bates, a resident of Popponesset, asked if the Board would support a Town Meeting <br /> article establishing an over-lay district of Popponesset to make the lots conform and Mr. <br /> Govoni said he would have to see the article. <br /> Mr. Slavinsky submitted a written request to withdraw the application. Mr. Govoni <br /> moved to grant the request to withdraw. Ms. Hawver seconded. All agreed. <br /> Owen W. and Georgia M Welch-Request a Special Permit under Sections 174-20 and <br /> 174-24 of the Zoning By-laws for the construction of a single family dwelling to replace a <br /> structure destroyed by fire on property located in an R-3 zoning district at 46 Spoondrift <br /> Way(Map 111, Block 128) Mashpee, MA. <br /> Members sitting: E. Govoni, J. Regan, C. Hawver <br /> Engineer Stephen Wilson represented the applicant and explained that the subject lot is not <br /> in the Cluster Special Permit area and complies with zoning. He stated that the original <br /> house on the lot had been destroyed by fire. Ms. Hawver moved to grant the Special <br /> Permit. Mr. Govoni seconded. All agreed. <br /> The Board found that the new septic system will improve the site conditions, that the <br /> setbacks-have been improved and that the By-laws allow the rebuilding. <br />
