Board of Appeals Minutes -March 26, 1997 2.
Dick Dube, a resident of Deer Crossing, asked about the entrance barrier. Mr. Wiseman
said the gate would be closed after 10 A.M. except for emergencies. Mr. Wiseman said
residents can call him directly with any problems on litter. Mr. Govoni moved to grant the
renewal of Section 4. Ms. Hawver seconded. All agreed. Mr. Govoni noted that the
decision should include the installation of the permanent barrier and conformance with the
Police Chief s recommendations.
Prime Properties Ltd. Partnership -Requests a Variance from Section 174-31 of the
Zoning By-laws for permission to vary the sideline setback requirements in an R-5 zoning
district on property located at 25 Sheffield Place(Map 29, Block 176)Mashpee, MA.
Members sitting: E. Govoni, C. Hawver, J. Dorgan
Mr. Regan stepped down from the Board for this hearing. Engineer John Slavinsky
represented the applicant. He explained that a foundation had been poured 12 feet from
the lot line in error. He said the site had been a stump dump and the soil is highly organic
and that the shape and topography of the lot prevented placement in any other location.
The house on the adjoining lot has been placed 30 feet off of the side lot line to allow a
greater distance between the two houses.
Mr. Dorgan moved to grant a Variance of 3 feet to allow a side line setback of 12 feet.
Mr. Govoni seconded. All agreed.
Cornish Nominee Trust -Requests a Special Permit under Sections 174-25.F.5 and 174-
25.H.6 of the Zoning By-laws for the retail sale and display of garden sheds and furniture
and children's jungle gyms on property located in a C-1 zoning district at 620 Falmouth
Road (Map 74, Block 6)Mashpee, MA.
Members sitting: E. Govoni, C. Hawver, M. Makunas
John Renz of Field's Point represented the applicant. He explained that he had just
returned from vacation and had contacted one of the members of the Deer Crossing
Condominium owners association and understood that other members were at the
meeting.. He said they are proposing a hoop house on the property and a display of
outdoor furniture for temporary use of the site until the master plan for the area is
completed.
Mr. Govoni explained that he had notified the Deer Crossing Association since they do not
appear on the abutters' list. He also explained that there will be a police officer on
weekends at the corner of Donna's Lane and Route 28. Comments were received from
members of the Deer Crossing Association questioning the appearance and the traffic.
Mr. Renz thought the increase in traffic would be minimal. A representative of the
company leasing the space said their experience at a Dennis location is approximately five
cars at a time.
