Board of Appeals Minutes- April 23, 1997 3. Ronald E. and Cheryl A. Nation and Martha M. Palank-Request a Variance from Section 174-25.I.9 of the Zoning By-laws for permission to exceed the 70' dock length limit on property located in an R-3 zoning district at 175 Daniel's Island Road (Map 100, Block 41) Mashpee, MA. Ronald E. and Cheryl A. Nation and Martha M. Palank- Request a Modification of Special Permit 85-09-058 to allow the expansion of an existing dock with a 6' x 20' float and a 12' x 20' float to replace an existing 12' x 16' float on property located in an R-3 zoning district at 175 Daniel's Island Road (Map 100, Block 41)Mashpee, MA. Members sitting: E. Govoni, C. Hawver, R. Nelson Mr. Nation explained that the modification to the dock has been approved by Conservation and the Harbormaster. Mr. Govoni read comments from the Shellfish Constable suggesting that the floats be extended to protect the shellfish beds. Mr. Nation explained that they were not removing the existing pier but will be changing the floats. Mr. Govoni explained that new engineering plans should be submitted with a dimension from the edge of marsh. He moved to grant the Variance of 65 feet to allow a total dock length of 136 feet including the existing pier and new floats. Ms. Hawver seconded. All agreed. Mr. Govoni moved to grant the Modification of the Special Permit to allow the expansion of an existing dock with a 6' x 20' float and a 12' x 20' float to replace an existing 12' x 16' float. Ms. Hawver seconded. All agreed. 99 Restaurant -Mr. Govoni moved to release the balance of the landscape bond. Mr. Dorgan seconded. Ms. Hawver made the vote unanimous. Plymouth Savings -Mr. Govoni moved to release the balance of the landscape bond. Mr. Dorgan seconded. Ms. Hawver made the vote unanimous. Minutes -Mr. Govoni moved to accept the Minutes of March 26, 1997. Ms. Hawver seconded. All agreed. Meeting adjourned at 9:00 P.M. Elinor Walsh ;� b.
