Board of Appeals Minutes - September 24, 1997 2.
Mr. Mohns informed the Board that he had converted a two-car garage into an apartment
in 1988 for use in the winter since it is independently heated from the main house. He
stated that the apartment has six exits and does not appear to be a two-family house. He
said there is no intention to use the property as a two-family house but he had concerns on
insurance coverage on the second kitchen. Mr. Hauck explained that a prospective buyer
wants to continue the use of the property in the same way.
Ms. Hawver moved to grant a Special Permit for an existing in-law apartment with the
condition that the apartment will not be rented but will be used by the owner for family
use. She found that the addition met the setback requirements. Mr. Dorgan seconded.
All agreed.
Fire Chief George Baker -Requested time to make comments concerning the Lipnosky
hearing since he had to attend another meeting. The Board agreed.
Chief Baker said he would like to comment generally on 174-32 of the By-laws since the
Board has many requests to vary this. He said that fire department vehicles have changed
so the department no longer uses brush breakers with four-wheel drive which were used
on dirt roads. He explained the the new vehicles have trouble with turns and cannot
handle pot holes and can make the best response to a fire on hard surfaced all-weather
roadways. He asked the Board to consider this when a Variance request is made.
Louis and Roberta A. Bevilacqua- Requests a Variance from Section 174-31 of the
Zoning By-laws for permission to vary the 15 foot side setback requirement to allow for
the addition of a closet on the north side of the house which will result in a side setback of
13 feet. The property is located in an R-3 zoning district at 27 Keel Way (Map 120 Block
135) Mashpee, MA.
Members sitting: E. Govoni, I Regan, C. Hawver
Architect Fred Giampetro represented the applicant and presented plans for an expansion
of the closet in the master bedroom. He explained that the house was in a flood plain and
could not have basement storage and would result in a 13 foot side line setback. Mr.
Nelson questioned the location of the swimming pool and if it met the setback
requirements. Mr. Hauck explained that the pool had been built in 1988 with a building
permit and that the statute of limitations had expired so that a variance for the swimming
pool was not required.
Mr. Regan moved to grant the Variance. Ms. Hawver seconded and all agreed.
