Board of Appeals Minutes -January 14, 1998 4. <br /> Mashpee Industrial Park Trust, Paul DeRuvter. TRS. -Requests a Special Permit under <br /> Sections 174-25.D.1-4 and 174-25.G.1-8 of the Zoning By-laws for a proposed 120 foot <br /> by 80 foot building to be used for shared office space and/or personnel and technology <br /> support for new start-up businesses (incubator space). The property is located in an I-1 <br /> zoning district at 370 Industrial Drive(Map 88, Block 41)Mashpee, MA. <br /> Members sitting: E. Govoni, C. Hawver, J. Dorgan <br /> Attorney Pat Butler represented the applicant and informed the Board that the office <br /> building and the telecommunications tower were part of the Development Agreement with <br /> the Cape Cod Commission. He explained that this was pre-permitting for approved used <br /> and reviewed the site plans. He said the proposed building will be used for start-up <br /> businesses. A letter was received from the Cape Cod Commission confirming that the <br /> applicant was in compliance with the Development Agreement. <br /> Mr. Butler reviewed the location of the building, and said the appearance had been <br /> changed as a result of the Design Review Committee. He reviewed the mitigation <br /> requirements of the Cape Cod Commission. The Board asked if all mitigation funds <br /> would be used in Mashpee and Mr. Govoni asked for a landscape plan. <br /> Wayne Duchemin of the Economic Development Committee spoke in favor of the <br /> application. <br /> Gay Wells of the Cape Cod Commission stated that there is an agreement with the <br /> Building Inspector that no building permits will be issued until the mitigation requirements <br /> have been met. There was discussion that the funds be used within Mashpee. Mr. Butler <br /> said he would not object to having a condition on using funds in Mashpee. <br /> Ms. Hawver moved to grant the Special Permit. Mr. Dorgan seconded. All agreed. <br /> The Permit is conditioned upon the following: <br /> 1, applicant will provide a Letter of Clarification to the Board of Appeals that the <br /> mitigation funds collected under the Development Agreement will be used in <br /> the Town of Mashpee. <br /> 2. the landscape plan be approved by the Design Review Committee <br /> 3. a landscape bond of$5,000 be posted <br /> 4. construction comply with revised plans <br />
