MASHPEE BOARD OF APPEALS <br /> Minutes <br /> Wednesday, January 28, 1998 <br /> The Mashpee Board of Appeals held a meeting on Wednesday, January 28, 1998 at 7:30 PM at <br /> the Mashpee Town Hall. Board Members present were Ed Govoni, Chairman, James E. Regan, <br /> III, Vice Chairman, Associate Members Michael A. Makunas, James Dorgan and Richard T. <br /> Guerrera. Cheryl Hawver, Clerk and Associate Member Robert Nelson were not present. <br /> Building Inspector William Hauck was in attendance. <br /> Public Hearings: <br /> Merry Meadow Enterprises. Inc., Requests a Variance from Section 174-31 of the Zoning <br /> By-laws for permission to vary the sideline setback of Building I (The Barn). The applicant <br /> proposes a 14 foot by 36 foot addition to the building for a cooler which will result in an 8 foot <br /> sideline setback. The property is located in a C-2 zoning district at 22 Falmouth Road (Map 55, <br /> Block 8). <br /> Members sitting: M. Makunas, E. Govoni, J. Regan. <br /> Appearing at the meeting for Merry Meadow was John Slavinski, Cape& Islands Engineering. <br /> Plans were reviewed. Mr. Slavinski explained that changing lot lines would create <br /> non-conformance with the current zoning. He stated the outside of the building would look the <br /> same. There was discussion by Mr. Slavinski regarding the planning board and their regulations <br /> and a concern that the planning board would not sign the plan, forcing him to come back. It was <br /> decided Mr. Slavinski should get planning board approval first. There was no public comment. <br /> E. Govoni made moved to deny the variance without prejudice. M. Makunas seconded. All <br /> agreed. <br /> Lois B. Tanzer - Requests a Special Permit under Sections 174-17, 174-20 and 174-33 of the <br /> Zoning By-laws for permission to demolish an existing cottage and replace it with a new home on <br /> property located in an R-5 zoning district at 69 Pickerel Cove circle (Map 14, Block 12). <br /> Members sitting: J. Dorgan, J. Regan, E. Govoni. <br /> Representing the Tamers was Tom Bunker, BSS Design. Plans were reviewed. The plan has <br /> been approved by the conservation commission with order of conditions. Zoning has changed <br />
