y T TOWN OF MASHPEE Board of Appeals Minutes Wednesday, June 24, 1998 The Mashpee Board of Appeals held a meeting on Wednesday, June 24 , 1998 at 7 : 30 p.m. at the Mashpee Town Hall, Meeting Room #)3 . Board members present were: James E. Regan, III, Vice Chairman; Cheryl A. Hawver, Clerk; and, Associate Members: Robert G. Nelson, James M. Dorgan and Richard T. Guerrera. Building Inspector, William F. Hauck, was in attendance. Francis J. and Nancy J. Goulart 9 Requests a Special Permit under Section 174-25. I. 9 of the Zoning By-laws for a seasonal dock on Wakeby Pond on property located in an R-5 zoning district at 58 Pimlico Pond Road (Map 3, Block 85) Mashpee, MA Richard T. Guerrera made a motion to grant special permit, Cheryl A. Hawver seconded. All agreed. Members sitting: Cheryl Hawver, Richard Guerrera, James Dorgan Michael McCarthy I Represented by D. Sanicki. Requests a Variance from Section 174-31 of the Zoning By-laws for permission to vary the front setback requirements for corner lots to allow a 29 foot setback from Jackbon Road and a 16 foot setback from Youngbon Terrace on property located in an R-3 zoning district at 30 Jackbon Road (Map 90, Block 95) Mashpee, MA (Owner of record: Daniel F. and Elaine C. Topping) . Robert G. Nelson made a motion for variance, seconded by James M. Dorgan. All agreed. Requests a Variance from Sections 174-11 and 174-31 of the Zoning By-laws for permission to vary the setback requirements on properties located in C-2 and R-5 zoning districts at 93 Old Brickyard Road (map 72 , Block 22) and 439 Nathan Ellis Highway (Map 72 , Block 23) Mashpee, MA (Owner of record: Henry C. Labute) Brickyard Marketplace Nominee Trust A Requests a Special Permit under Sections 174-25. D. 1, 174-25 .E. 1, 174-25.E. 2 , 174-25.E. 4 and 174-25.H. 6 of the Zoning By-laws for use for retail businesses on properties located in C-2 and R-5 zoning districts at 93 Old Brickyard Road (Map 72 , Block 22) and 439 Nathan Ellis Highway (Map 72 , Block 23) Mashpee, MA. (Owner of record: Henry C. Labute) . Engineer, Michael Grotzke, submitted plans for commercial district, commercial building plans for retail, small restaurant with limited 55 seating. Opposition was forthcoming from the audience, all living within the proposed area: Gerard Labute, D. Stoyle, Jane Labute, Chris Shuto, Ray Watson, Maureen Quinlan.
