TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> Minutes <br /> Thursday, July 16, 1998 <br /> The Mashpee Board of Appeals held a meeting on Thursday, July 16, 1998 at 5:00 <br /> P.M. at the Mashpee Town Hall. Board Members present and acting throughout were: <br /> Edward M. Govoni, Chairman; Cheryl A. Hawver, Clerk and Associate Member Robert <br /> G. Nelson. <br /> Board Members absent were: James E. Regan III, Richard T. Guerrera, James M. <br /> Dorgan and Michael A. Makunas. <br /> Mr. Govoni called the meeting to order at 5:20 P.M. <br /> Willowbend Development Corporation -Requests a Variance from Section 174-31 of the <br /> Zoning By-laws for permission to vary the minimum lot size requirement for the properties <br /> listed on Schedule A all of which are located in an R-3 zoning district and shown on Plan <br /> of Shoestring Bay Estates dated May 6, 1998, recorded with Barnstable County Registry <br /> of Deeds at Book 541, Page 26. <br /> Members sitting: E. Govoni, C. Hawver, R. Nelson <br /> The Board members reviewed the plans for the 35 lots and stated that the two plans <br /> references be included in the Decision. One plan dated 12/16/97 was recorded as 541-26 <br /> to 541-29 and the other dated May 6, 1998 was recorded as 541-30 to 541-33. <br /> Ms. Hawver moved to grant the Variances in lot sizes for lots 1 through 35 as per <br /> Schedule A attached with the findings and conditions per attached and an additional <br /> condition that both of the above plans be referenced. <br /> Mr. Nelson asked to make a statement: "in approving this, or assuming we approve it, I <br /> would like to point out that we have virtually created a new subdivision but beyond that, <br /> where the lots are small, it has been with the assurance of the petitioner that these are <br /> buildable lots. I, as an individual, would not look with any favor on future requests for <br /> setback or sideline variances." He then seconded Ms. Hawver's motion. <br /> Mr. Govoni stated that he felt the Board could consider variances in lot coverage and <br /> height. Mr. Govoni voted in favor of the application making the vote unanimous. <br /> Mr. Nelson moved to adjourn at 5:35 P.M. <br /> Elinor Walsh// <br />
