TOWN OF MASHPEE <br /> Board of Appeals <br /> Minutes <br /> Wednesday, September 23, 1998 <br /> The Mashpee Board of Appeals held a meeting on Wednesday, September 23, 1998, at <br /> 7:30 P.M. at the Mashpee Town Hall. Board Members present were Chairman Edward <br /> M. Govoni, Vice Chairman James E. Regan III and Robert G. Nelson and Associate <br /> Members James M. Dorgan and Richard T. Guerrera. Board Member absent was <br /> Associate Member Michael A. Makunas. Building Commissioner William F. Hauck and <br /> Local Inspector Russell W. Wheeler were in attendance. <br /> Thomas F. Smith -Requests a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the frontage setback requirements on property located in an R-3 zoning <br /> district at 266 Monomoscoy Road (Map 120 Block 57B)Mashpee, MA. <br /> Thomas F. Smith -Requests a Special Permit under Section 174-25 H.7, of the Zoning <br /> By-laws for permission to construct a garage on property located in an R-3 zoning district <br /> at 266 Monomoscoy Road (Map 120 Block 57B)Mashpee, MA. <br /> Mr. Govoni moved to continue until October 14, 1998 Mr. Smith's requests for a <br /> Variance and Special Permit due to the fact that no plans were available for the Board to <br /> review. Mr. Nelson seconded. All agreed. <br /> William J. Cohen -Requests a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the front setback and lot coverage requirements on property located in <br /> an R-3 zoning district at 9 Chart Way(Map 106 Block 17)Mashpee, MA. <br /> Members sitting: Edward M. Govoni, James E. Regan III and Robert G. Nelson. <br /> Norman Hayes of the BSC Group represented the applicant whose property is located in <br /> New Seabury. He indicated that the applicant has received authorization from the Board <br /> of Health to move two cesspools and install a new Title V septic system. He also has <br /> approval from the Conservation Commission to construct the addition and porch. He <br /> informed the Board that the existing shed and patio will be removed. Since the coastal <br /> bank prevents building on a portion of the property, the proposed construction has been <br /> moved to Chart Way, necessitating the request for a five-foot front setback variance. The <br /> applicant is also requesting a variance of 2% on the lot coverage. No comments were <br /> received from abutters. <br /> Mr. Regan moved to grant the Variance, subject to criteria 1-4 and findings 1-3. Mr. <br /> Nelson seconded. All agreed. Mr. Govoni questioned whether the applicant needed a <br /> Special Permit to expand a non-conforming structure. He informed the applicant he <br /> would investigate and provide him with an answer. <br />
