TOWN OF MASHPEE <br /> Board of Appeals <br /> Minutes <br /> Wednesday, October 14, 1998 <br /> The Mashpee Board of Appeals held a meeting on Wednesday, October 14, 1998, at 7:30 <br /> P.M. at the Mashpee Town Hall. Board Members present were Chairman Edward M. <br /> Govoni, Vice Chairman James E. Regan III, Robert G. Nelson and Associate Member <br /> Richard T. Guerrera. Board Members absent were Associate Members James M. Dorgan <br /> and Michael A. Makunas. Local Inspector Russell W. Wheeler was in attendance. <br /> Mr. Govom opened the meeting by making a motion to continue the hearings for the <br /> Brickyard Marketplace Nominee Trust due to the absence of Associate Board Member <br /> James M. Dorgan. Mr. Nelson seconded. All agreed. <br /> Thomas F. Smith -Requests a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the frontage setback requirements on property located in an R-3 <br /> zoning district at 266 Monomoscoy Road (Map 120 Block 57B)Mashpee, MA. <br /> Thomas F. Smith-Requests a Special Permit under Section 174-25 H.7. of the Zoning <br /> By-laws for permission to construct a garage on property located in an R-3 zoning district <br /> at 266 Monomoscoy Road (Map 120 Block 57B)Mashpee, MA. <br /> Members sitting: Edward M. Govoni, James E. Regan III and Robert G. Nelson. <br /> Mr. Govoni stated that the Conservation Commission denied Mr. Smith's case, with <br /> prejudice. He questioned Mr. Smith as to why he failed to appear before the <br /> Conservation Commission at their meeting. Mr. Smith insisted that the Board of Appeals <br /> has to render a decision before he can appear before the Conservation Commission. Mr. <br /> Govoni informed Mr. Smith that the Board of Appeals has to know the location of the <br /> proposed building in order to grant a Variance and, further, the Conservation <br /> Commission must approve the location of the building. No comments were received <br /> from abutters. <br /> Mr. Govom moved to deny without prejudice, Mr. Smith's request for a Variance and <br /> Special Permit, Mr. Nelson seconded. All agreed. <br /> Donald Hansen -Requests a Variance from Section 174-32 of the Zoning By-laws for <br /> permission to construct a single-family dwelling on an unpaved road on property located <br /> in an R-3 zoning district at 86 Blue Castle Drive(Map 104 Block 15), Mashpee, MA. <br /> Members sitting: Edward M. Govoni, James E. Regan III and Robert G. Nelson. <br /> Mr. Hansen represented his proposal to construct a single-family, two-bedroom home on <br /> Blue Castle Drive. Mr. Govoni read a letter submitted by Deputy Fire Chief Hamblin <br />
