Board of Appeals Minutes—October 28, 1998 4
Mr. Regan clarified that the front left corner of the garage meets the fifteen-foot setback
requirements and that only a minute portion of the back corner needs relief of 4.1 feet
from the setback requirements. He also said that lot coverage, including the garage, is
still small. Mr. Govoni said the Board could condition granting the Variance, subject to
screening that would be acceptable to the abutters. He suggested that, although the Board
feels the project is reasonable, the application be continued until the owner and the
abutter in opposition could agree on a specific type of screening. On discovering that the
Board would have to continue the application until December, they suggested to come to
some sort of agreement at this hearing.
Mr. Nelson moved to grant the Variance of 4.1 feet with the following conditions:
1. an agreement for an evergreen screening to be arrived at between the
petitioner and the abutters,the Connolly's.
2. the screening will be a minimum of five feet in height and four feet on center.
3. the screening will be planted from the front to the back of the house.
4. criteria 1 —4,findings 1,
5. topography of the lot, only house in neighborhood without a garage.
6. it will benefit the neighborhood.
Mr. Regan seconded. All agreed.
John J. Trotto-Requests a Special Permit under Section 174-20 of the Zoning By-laws
for permission to demolish an existing structure and construct a three-bedroom home on
property located in an R-3 zoning district at 55 Quaker Run Road(Map 90 Block 40),
Mashpee, MA. (Owner of record: Lucy T. Cromwell.)
Members sitting: Edward M. Govoni, Robert G. Nelson and Richard T. Guerrera.
Stephen Doyle of Stephen J. Doyle and Associates represented the applicant stating that
the proposal is to demolish an existing dwelling in disrepair on the lot and construct a
three-bedroom home. Lots 39 and 40 have been combined and are now Lot 40. Lot
coverage is 11%. The lot has town water and gas utility services.
An abutter,Michael Hope, expressed interest in the project. No other comments were
received from abutters.
Mr. Nelson moved to grant the Special Permit, stating that the removal of the old
dwelling will be beneficial to the neighborhood and the construction of the three-
bedroom home does not require relief from any of the zoning by-laws. Mr. Guerrera
seconded. All agreed.
