Board of Appeals Minutes— October 28, 1998 6 <br /> John Slavinsky of Cape& Islands Engineering represented the applicant and stated that <br /> the owner proposes to extend the house sixteen feet and add a 26 foot by 24 foot garage. <br /> The sloping and narrow topography of the lot makes it necessary for the applicant to seek <br /> relief from the setback requirements. The existing cesspool will be removed and a new <br /> Title V septic system will be installed. The Conservation Commission has concerns and <br /> has asked the applicant to maintain a 50 foot buffer. Mr. Dorgan strongly recommended <br /> Mr. Slavinsky to submit plans marked by a qualified individual indicating where the <br /> buffer zone is. <br /> Mr. Guerrera moved to continue the hearing, subject to the applicant submitting plans to <br /> the Board of Appeals that indicate the area of the wetlands and the buffer zone. Mr. <br /> Nelson seconded. All agreed. <br /> Brickyard Marketplace Nominee Trust -Requests a Variance from Sections 174-11 and <br /> 174-31 of the Zoning By-laws for permission to vary the setback requirements on <br /> properties located in C-2 and R-5 zoning districts at 93 Old Brickyard Road (Map 72, <br /> Block 22) and 439 Nathan Ellis Highway(Map 72,Block 23)Mashpee, MA. (Owner of <br /> record: Henry C. Labute). <br /> Brickyard Marketplace Nominee Trust-Requests a Special Permit under Sections 174- <br /> 25.D.1, 174-25.E,1, 174-25.E.2, 174-25.E.4 and 174-25.H.6 of the Zoning By-laws for <br /> use for retail businesses on properties located in C-2 and R-5 zoning districts at 93 Old <br /> Brickyard Road (Map 72,Block 22)and 439 Nathan Ellis Highway(Map 72,Block 23) <br /> Mashpee, MA. (Owner of record: Henry C. Labute). <br /> Members sitting: James E. Regan III, James M. Dorgan and Robert G. Nelson. Mr. <br /> Govoni stepped down. <br /> Mr. Michael Grotzke of the Phoenix Group represented the applicant and submitted an <br /> accurate plot plan. He informed the Board that at the Design Review Committee Meeting <br /> of October 14, 1998 further landscaping changes have been proposed. After meeting <br /> with Greg Taylor, Director, DPW, paving and grading will be done as specified by the <br /> Massachusetts State Highway Department and as indicated on the plan. Berms and the <br /> slope of the street will prevent the water from collecting on the streets. The applicant <br /> will patch potholes on Massasoit Avenue. The applicant will comply with the road <br /> details as outlined in the memo dated October 13, 1998 from Greg Taylor, Director. Mr. <br /> Nelson suggested that a base coat be laid down prior to issuing any building occupancy <br /> permits. Mr. Hauck indicated that the applicant has not submitted revised plans for <br /> approval by Design Review. These plans will then be submitted to the Board of Appeals. <br /> A neighbor, Chris Shute, indicated that he was satisfied with the plans. He expressed the <br /> opinion that no paving on Sassacus or filling of potholes on Massasoit is done to <br /> discourage traffic from coming down those heavily populated streets. No other <br /> comments were received from abutters. <br />
