BOX 393 OSTERVFL .MASSACHUSETTS 020SS-0393 FACSIMILE <br /> 508)4264800 (SOB)42641 i I <br /> Mashpee Zoning Board of Appeals August 27 , 1996 <br /> Mashpee Town Hall <br /> Mashpee, Mass . <br /> Re: Mashpee Industrial Park <br /> Request For Special Permit <br /> Map 88 Block 34 <br /> Dear Board Members : <br /> I represent Richard and Madeline Crowley who are the owners of Lot <br /> 23 which is situated across the street from the lot which is the <br /> subject of this special permit application. <br /> The Crowleys oppose this application. <br /> This application does not begin to comply with the requirements <br /> which must be met in order for the Board to issue a special permit . <br /> Special permits may be issued only for a specific use which the <br /> bylaw has specifically placed in a category of eligibility for such <br /> permits . Such permits may be granted by a Board of Appeals only <br /> after considering the criteria found in M.G.L. c. 40A section 9, <br /> and the criteria set forth in the bylaw, and determining that the <br /> subject application and the proposed use meet that criteria. <br /> The application now before the Board fails to adequately indentify <br /> and describe what uses will be taking place in this very large <br /> building. The applicant is seeking, in advance, blanket approval to <br /> carry on each and every use which is referred to in sections <br /> D. 1-5, G. 1-10, and H. 6 . <br /> The application on it' s face acknowledges that the "final use" (is) <br /> "to be determined" . <br /> The application suggests that the building will contain anywhere <br /> from one ( 1 ) to five (5 ) different units . This will have a bearing <br /> on the size of the units and the amount of floor space which will <br /> be devoted to each future use.The plans also refer to a 'sales <br /> area" , whereas retail sales are not allowed under D. , G. , or H. <br /> The plans would suggest that each of up to five units would have <br /> combined uses of office space, retail sales areas, and warehouse <br /> soace . One does not know if these various uses within one unit are <br /> all part of the same enterprise, or separate activities . The <br /> parking required for these uses is difficult to calculate. <br /> The Board should note that if this building were another inch <br /> longer, it would contain 10 , 000 square feet and would require <br /> review by the Cape Cod Commission <br />
