Town of Mashpee <br /> Board of Appeals <br /> September 11, 1996 <br /> Public Hearing <br /> Mashpee Water District <br /> Continued from August 28, 1996 <br /> The duly scheduled and posted Board of Appeals Public <br /> Hearing was called to order at the Carol H. Jacobson Senior <br /> Center, 500 Great Neck Road North, Mashpee, Massachusetts at <br /> 7: 55 p.m. on Wednesday, September 11, 1996 by the Chairman, <br /> Edward M. Govoni. <br /> Board of Appeals Members present: Edward M. Govoni, <br /> Chairman; James E. Regan III, Vice Chairman; Cheryl A. Hawver, <br /> Clerk; and Associate Members Richard T. Guerrera <br /> and Robert G. Nelson. <br /> The Chairman recognized James E. Regan III, Vice Chairman, <br /> for the purpose of reading Notice of Public Hearing in this <br /> matter. <br /> Mr. Regan: Mashpee Water District has Appealed the Decision <br /> of the Building Inspector denying a request for Zoning <br /> enforcement pursuant to M.G.L. Ch.40A, Section 7. The District <br /> had requested that permits issued to New Seabury under the <br /> Modification Agreement of May 22, 1995, between the Town of <br /> Mashpee and New Seabury Operations Nominee Trust be revoked and <br /> that the Modification Agreement itself be rescinded or that the <br /> Board determine that Zoning Board of Appeals action is necessary. <br /> The subject property is known as Section 5 of the New Seabury <br /> Cluster Development and is located at 155 and 163 Rock Landing <br /> Road, (Map 116, Blocks 70 and 70A) , 70 Cross Road (Map 116-74) . <br /> (Owner of record: Christopher Burden, Trustee N.S. Operations <br /> Nominee Trust) and 24 Mall Way (Map 116, Block 69) (Owner of <br /> Record: Christopher Burden. ) <br /> Members Sitting: Edward Govoni, James Regan, Cheryl Hawver <br /> The Chairman recognized Attorney William Henchy. <br /> Attorney Henchy: Good evening uh. . .Mr. Chairman. For the <br /> record, my name is William Henchy, I 'm Counsel for the Mashpee <br /> Water District. Uh. . .and I appear before you tonight <br /> representing the. . .the District . <br /> Um. . . the Board was kind enough to continue the Hearing from <br /> the last meeting so that I could present some documents that I <br /> was unable to present that evening. Um. . . I have those documents <br /> together with a very brief Memo uh. . . setting forth our position. <br /> I ' ll share the original . And I have for the other members of the <br /> Board. In addition, um. . . ju. . . just to reiterate very. . .very <br /> briefly and to refresh the Board' s memory. Um. . . it was our <br /> position at the last Hearing that the 1964 Special Permit <br /> uh. . . approved a specific Plan. In the uh. . . Plan it allowed <br />
