I <br /> OT,7NE._ <br /> 9 3621 PUBLIC <br /> t RSHIP - The common oven space shall <br /> be conveyed to the Town of Mashpee and accented by it <br /> 1 for park or open space use. ` <br /> 9. 3622 OWNERSHIP BY NON-PROFIT ORGANIZATION - The common <br /> open space shall be conveyed to a non-profit organization, <br /> the principal purpose of which is the conservation of <br /> open space . The non-profit organization <br /> shall execute <br /> a restriction enforceable by the Town of *Rashnee which <br /> shall be recorded at the Barnstable County Registry of <br /> Deeds providing that such land shall be kept in an open <br /> and natural state and shall not be built for residence <br /> use or developed for accessory uses such as narking or <br /> roadway. The non-profit organization shall own and shall <br /> maintain the common oven space and shall not dispose of. <br /> any of the common open space by sale or otherwise except <br /> that said non-profit organization may offer to convey <br /> such common open space to the Town of Mashnee for <br /> acceptance by it for park or open space use. <br /> 9 . 3623 OWNERSHIP BY CORPORATION OR TRUST - The open <br /> space shall be conveyed to a corporation or trust owned <br /> or to be owned by the owners of lots or residential units <br /> within the development. Ownership of the corporation <br /> r or trust shall pass with conveyance of the lots or <br /> residential units. The corporation or trust shall exe- <br /> cute a restriction enforceable by the Town of Mashnee <br /> which shall be recorded at the Barnstable County Registry <br /> of Deeds and said restriction shall provide that such <br /> land shall be kept in an open and natural state and not <br /> be built for residence use or developed for accessory <br /> uses such as parking or roadway. The corporation or <br /> trust shall own and maintain the common open space and <br /> shall not dispose of any of the common open space by <br /> sale or otherwise except that said corporation or trust <br /> may offer to convey such common open space to the Town <br /> of Mashnee for acceptance by it for nark or open space <br /> use. <br /> 9. 363 In the event that the organization established to own and <br /> maintain the open space, or any successor organization, shall <br /> at' any time after establishi_ient of the oDen space residential <br /> development fail to maintain the open space in reasonable order d <br /> and condition in accordance with the plan, the Town of Plashpee <br /> will serve written notice upon such oraan.ization or upon the <br /> residents of the open space residential development settina forth <br /> the manner in which the organization has failed to maintain the <br /> open space in reasonable conditions, and said notice shall in- <br /> clude a demand that such deficiencies of maintenance be cured <br /> within thirty (30) days thereof, and shall state the date and <br /> place of fearing hereon which shall be held within fourteen (14) i <br /> days of the notice. At such hearing the Town of Mashnee may <br /> modify the terms of the original notice as to the deficiencies <br /> and may give an extension of time within which they shall be <br /> II <br /> -26- <br />
