and approved by Attorney General September <br /> 14, 19847 . <br /> Section 4.7.5. 1 Divers and Diving Any person or <br /> persons skin diving or scuba diving shall : <br /> a7 Display a diver's flag constructed of <br /> rigidly supported material at least 12 <br /> inches by 15 inches in area of red <br /> background with a white diagonal stripe . <br /> b7 Display such flag on a boat or r <br /> surface float extending a minimum distance <br /> of 3 feet from the surface of the water , <br /> or to such other height in excess of 3 <br /> feet , as to be sufficient to be visible to k <br /> Passing boats. c7 stay in an area within <br /> 1010 feet of such displayed diver's flag t <br /> while at or near the surface of the water . <br /> i <br /> (Amended at Annual Town Meeting May 3, 1982 <br /> and approved September 7, 1982) . <br /> Section 4.7.6 Enforcement and Penalties. <br /> a. Unless otherwise specified, the <br /> Provisions of this by-law shall be enforced f <br /> by the Harbormaster , Assistant <br /> Harbormasters and by police officers I' <br /> empowered to patrol the waters of the <br /> Town of Mashpee . <br /> I� <br /> b. The Board of Selectmen may <br /> appoint a Director of Inland Waters and i <br /> may appoint Assistant Directors of Inland <br /> Waters to serve for one year or until a <br /> successor is appointed and qualified,* with <br /> Police powers for each of the ponds within <br /> the Town , to enforce the by-law relative <br /> to use of waterways. Such person or <br /> persons shall be at the recommendation of <br /> and responsible to the Police Chief and <br /> the Selectmen . The duties and <br /> responsibilities of this position are to <br /> provide full authority to enforce all <br /> laws, rules and regulations of the <br /> Mashpee inland waterways, with a primary <br /> concern for public safety and the <br /> preservation of our natural water <br /> resources. In the exercise of any police <br /> power conferred herein , the Director and/or <br /> Assistant Directorshall come under the c <br /> administrative control of the Police <br /> Department of the Town . <br /> C . Whoever violates any of the provisions <br /> of this by-law and refuses to obey the <br /> -79- <br />
