[r <br /> f <br /> Section 4.5.3.4 Penalties. <br /> Any person who violates Section 4.5.3.2a), 4.5.3.2b), 4.5.3.2 c), <br /> 4.5.3.2d) shall. be subject to a fine of fifty (50) <br /> dollars for the first offense and One Hundred (100) <br /> dollars for a second or subsequent offense. <br /> Any person who violates Section 4.5.3.2e), 4.5.3.2F), 4.5.3.2.g) <br /> 4.5.3.2h), 4.5.3.2.1), 4.5.3.2j) , 4.5.3.2k),4.5.3.21) , g <br /> 4.5.3.2m), 4.5.3.2n) , 4.5.3.20) , or 4.5.3.2p) shall be <br /> punished by a fine of Twenty Five (25) dollars. <br /> Any such violation shall constitute a separate offense <br /> on each successive occurrence. <br /> "The provisions of Massachusetts General Laws Chapter 40, <br /> Section 21D providing for the noncriminal disposition of <br /> by-law violations shall be applicable and the person taking <br /> cognizance of any violation shall have available as an <br /> alternative to initiating criminal proceedings the procedure <br /> set forth in Section 21D as aforesaid." <br /> Section 4.5.3.5 "In the event that any part of this by-law is found to be <br /> inconsistent with any other provisions contained in other <br /> sections of the Town by-laws, it is intended that this <br /> particular by-law shall take precedence and control. <br /> In the event that any part of this by-lawis declared viod::for any <br /> reason, by. any court of competent jurisdiction, the remainder thereof' ! <br /> shall continue in full force and effect." <br /> (Amended by Annual Town Meeting May 3, 1982 and approved by <br /> Attorney General September 7, 1982) <br /> Section 4.5.4 garaged, Unregistered Vehicles. No person shall have more <br /> than one unregistered car or truck ungaraged on his premises <br /> in a Residential District at any time. In no event will an <br /> unregistered car or truck be stored in the front yard. <br /> Violaters shall be fined in an amount not exceeding $20.00 <br /> for each offense. <br /> Section 4.5.5 Deleted at Annual Town Meeting May 3, 1982 and approved <br /> by Attorney General September 7, 1982w <br /> Section 4.5.6 Sleeping in Public. No person shall sleep in a motor vehicle <br /> parked upon any public way or public parking area, or sleep in <br /> the open on any beach within the limits of the Town of Mashpee L <br /> between the hours of 9:00 p.m. and 6:00 a.m. Any person <br /> violating this by-law shall be punished by a fine of not more <br /> than $50.00 for each offense. <br /> Section 4.5.7 Deleted at Annual• Town Meeting May 3, 1982 and approved by <br /> Attorney General September 7, 1982. <br /> ib <br /> 24 <br />
