Upon receipt of the written approval of those property owners hearing 50% or tn,-rt aL thtest irjat+.id cost , the Selectmen shall proceed to layout the way and upon completion of the layout shall cause an appropriate Article to *be inserted in the next Annual Town Meeting for action. Upon approval of the Article by the voters at the Town Meeting , the proposed work to construct , reconstruct , or repair the private way , shall be put out to public bid and within six months following the completion of the work, the total cost shall be apportioned by the Selectmen, with the assistance of the Town Engineer and the Board of Assessors , to the owners of the land abutting the way and to any other owners of land deemed to be benefited, and betterments shall be assessed to them in accordance with the provisions of the General Laws of the Commonwealth for assessing betterments . (Amended at Special Town Meeting, October 27 , 1982, approved by Attorney General January 11 , 1983) f. The provisions of this by-law shall not be deemed in any way to restrict t'he authority of the Board of Selectmen to initiate action on their own to cause any private way to be accepted as a public way. The provisions of Massachusetts General Laws, Chapter 40, Section 21D, providing for the non-criminal disposition of By-law violation, shall be applicable to all violations of Town By-laws wherein a specific penalty is provided for said violation. Whoever violates any of the provisions of Chapter 4 of the By-laws, unless otherwise provided for therein, shall be punished by a fine of not less than $20.00, nor more than $50.00. Each day a violation occurs shall be considered a separate offense. (Amended at Annual Town Meeting May 2, 1983 and approved by Attorney General October 12, 1983.) I 36 j
