Upon receipt of the written approval of <br /> those property owners hearing 50% or <br /> tn,-rt aL thtest irjat+.id cost , the Selectmen <br /> shall proceed to layout the way and upon <br /> completion of the layout shall cause an <br /> appropriate Article to *be inserted in the <br /> next Annual Town Meeting for action. Upon <br /> approval of the Article by the voters at the <br /> Town Meeting , the proposed work to construct , <br /> reconstruct , or repair the private way , shall <br /> be put out to public bid and within six months <br /> following the completion of the work, the total <br /> cost shall be apportioned by the Selectmen, <br /> with the assistance of the Town Engineer and <br /> the Board of Assessors , to the owners of the land <br /> abutting the way and to any other owners of <br /> land deemed to be benefited, and betterments <br /> shall be assessed to them in accordance with the <br /> provisions of the General Laws of the Commonwealth <br /> for assessing betterments . (Amended at Special <br /> Town Meeting, October 27 , 1982, approved by <br /> Attorney General January 11 , 1983) <br /> f. The provisions of this by-law shall not be <br /> deemed in any way to restrict t'he authority <br /> of the Board of Selectmen to initiate action <br /> on their own to cause any private way to be <br /> accepted as a public way. (Sections d and e <br /> amended at Town Meeting, May 18, 1981 , approved <br /> by Attorney General August 19, 1981) <br /> _.A..rtAc l e 4. 11 Penalties . The provisions of Massachusetts General Laws, <br /> Chapter 40, Section 21D, providing for the non-criminal <br /> disposition of By-law violation, shall be applicable to <br /> all violations of Town By-laws wherein a specific penalty <br /> is provided for said violation. <br /> Whoever violates any of the provisions of Chapter 4 of the <br /> By-laws, unless otherwise provided for therein, shall be <br /> punished by a fine of not less than $20.00, nor more than <br /> $50.00. Each day a violation occurs shall be considered <br /> a separate offense.
