MASS, FORM 886 <br />18-0-88 CONDUIT AGREEMENT—CITY/TOWN <br />1 <br />i✓ <br />WHEREAS by an order of the Board of Selectmen of the City/Town of <br />PW Mashpee, Massachusetts, dated September 2, 1965 <br />permission has been granted to the NEW ENGLAND TELEPHONE AND TELEGRAPH COMPANY <br />to lay and maintain underground conduits and manholes, with the wires and cables to be placed therein, <br />under the surface of: <br />Nathan Ellis Highway <br />as referred to in said order, to which order reference may be had, <br />NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS that said NEW ENGLAND TELE- <br />PHONE AND TELEGRAPH COMPANY in consideration of the premises and in compliance with the <br />terms and requirements of said order, doth hereby for itself and its successors and assigns, covenant and agree <br />to and with the said Qty/Town of Mashpee as follows: <br />1. In every underground conduit constructed by said Company under said order one duct not less than <br />three inches in diameter shall be reserved and maintained free of charge for the use of the fire, police, tele- <br />phone and telegraph signal wires belonging to the GiLy�Town and used by it exclusively for municipal purposes. <br />2. That said Company shall indemnify and save harmless the said i3ity/Town against all damages, <br />costs and expense whatsoever to which the City/Town may be subjected in consequence of the acts or neglect <br />of said Company, its agents or servants, or in any manner arising from the rights and privileges granted it <br />by the Gity/Town. <br />3. That said Company will before a street is disturbed for the laying of its wires or conduits execute its <br />bond in a penal sum of Five Thousand Dollars ($ 5, 000 ) (reference being had to <br />the bond already on file with said City/Town) conditioned for the faithful performance of this agreement <br />and of its duties under said permit. <br />IN WITNESS WHEREOF said NEW ENGLAND TELEPHONE AND TELEGRAPH COMPANY <br />has caused these presents to be signed in its name and behalf by J.
