ORDERED: That permission be and hereby is granted the NEW ENGLAND TELEPHONE AND TELEGRAPH COMPANY to lay and maintain underground conduits and manholes, with the wires and cables to be placed therein, under the surface of the following public way or ways as requested in petition of said Company dated the f 1( CA day of JAN. 19 87 ROUTE 130 PROPOSED: ONE (1) MANHOLE 4 DUCTS RUNNING EASTERLY FROM PROPOSED MANHOLE 113 APPROX. 10' THEN TURNING SOUTHERLY RUNNING APPROX. 138' TO POLE 4/1 . 2 DUCTS FROM POLE 4/1 CONTINU- ING SOUTHERLY APPROX. 129 ' TO POLE 1/76. ALSO, 9 DUCTS RUNNING FROM PROPOSED MANHOLE 113 SOUTHERLY APPROX. 15' TO EXISTING MANHOLE 112A. Substantially as shown on plan marked—N. E. T. & T. CO., No. 87-503 Dated )-14-87 filed with said petition. Also that permission be and hereby is granted said NEW ENGLAND TELEPHONE AND TELE- GRAPH COMPANY to lay and maintain underground conduits, manholes, cables and wires in the above or intersecting public ways for the purpose of making connections with such poles and buildings as it may desire for distributing purposes. The foregoing permission is subject to the following conditions: 1. The conduits and manholes shall be of such material and construction and all work done in such manner as to be satisfactory to the Board of Selectmen or to such officers as it may appoint to the supervision of the work, and a plan showing the location of conduits constructed shall be filed with the Town whenthe work is completed. 2. In every underground main line conduit constructed by said Company hereunder one duct not leu than three inches in diameter shall be reserved and maintained free of clurge for the use of the fire and police telephone and telegraph signal wires belonging to the Town and used by it exclusively for municipal proposes. 3. Said Company shall indemnify and save the Town harmless against all damages, costs and expense whatsoever.to which the Town may be subjected in consequence of the acts or neglect of said Company, its agents or servants, or in any manner arising from the rights and privileges granted it by the Town. a. in addition said Company stall, before a public way is disturbed for the laying of its wim or conduits, execute its bond in a penal sum of Five Thousand Dollars ($5,000) (reference being had to the bond already on file with aid Town) conditioned for the faithful performance of its duties under this permit. 5. Said Company shall comply with the requirements of ousting by-laws and such as may hereafter be adopted governing the construction and maintenance of conduits and wires, so far as the same arc not inconsistent with the laws of the Commonwealth. - I hereby certify that the foregoing order was adopted at a meeting of the Board of Selectmen of the Town of............. ..MASHPE..........................Massachusetts, held on the..... ............ .... . 4t.h.....day of ...eb.r.u.a.r..49 87 Clerk of Selectmen.
