Assemble for the purpose of engaging <br /> in any fraudulent schemes, devices, <br /> artifices or tricks to obtain any <br /> monies or things of value in any place <br /> or places from any person or persons; <br /> All pronouns used herein shall be construed <br /> in the masculine, feminine or neuter <br /> genders, and the term "person" shall be <br /> construed in the singular or plural and <br /> shall include real persons, associations or <br /> corporations. <br /> Section 4.5.3.3 Exemptions <br /> This by-law shall not be construed to <br /> suppress the right to lawful assembly, <br /> picketing, public speaking or other <br /> lawful means of expressing public <br /> opinion not in contravention of other <br /> laws or by-laws nor to infringe upon the <br /> right of any law enforcement officer <br /> engaged in the performance of his duties. <br /> 'I Section 4.5.3.4 Penalties. <br /> Any person who violates Section 4.5.3.2 a) , <br /> j 4.5.3.2 b) , 4.5.3.2 e) , 4.5.3.2 d) , shall be <br /> subject to a fine of fifty (50) dol tars for <br /> i <br /> the first offense and One Hundred ( 100) <br /> dollars for a second or subsequent offense. <br /> Any person who violates Section 4.5.3.2 e) , <br /> I; 4. 5.3.2 f) , 4.5.3.2 g) , 4 .5.3. 2 h) , <br /> 4.5.3.2 i ) , 4.5.3.2 j ) , 4.5.3.2 k) , <br /> 4.5.3.2 1 ) , 4.5.3.2 m) , 4 . 5.3.2 n) , <br /> 4.5.3.2 0) , or 4.5.3.2 p) shall be punished <br /> by a fine of Twenty Five (25) dollars. <br /> Any such violation shall constitute a <br /> separate offense on each successive <br /> occurrence . <br /> "The provisions of Massachusetts General <br /> Laws Chapter 40 , Section 21D providing for <br /> the noncriminal disposition of by-law <br /> violations shall be applicable and the <br /> person taking cognizance of any violation <br /> i <br /> shall have available as an alternative to <br /> initiating criminal proceedings the <br /> procedure set forth in Section 21D as <br /> aforesaid.
