BY.-Law 4 . 5 . 1a occurs shall be deemed to have made , aided , caused, suffered, I countenanced , or otherwise assisted in the making of the said improper noises and shall be punished by a fine of not more. than $50 . 00 for each offense . i Section 4 . 5. 2 Alcoholic Beverages - Minors. . It sha.l1 be unlawful for any person who has not attained the age as determined, from time to time , by the General Court of the Commonwealth of Massachusetts as being the lawful age for consumption of 1 alcohol to consume or knowingly have in I his or her possession alcoholic beverages on public highways , including vehicles thereon , or in public places within the Tovin of Mashpee . Whoever violates the provisions of this by-law shall be fined in an amount not exceeding $50 .00 for each offense . Section 4.5. 3 Disorderly Conduct Section 4.5.3. 1 Definition . "Public Place " shall mean any place , structure or building to which the general public has access and a right to resort for business, entertainment , or other l avjfu 1 purpose , but does. not necessarily mean a. place devoted soler to the uses of the public . It shall also include the front , parking lot or i immediate area of any store , shop , restaurant , tavern , or other place of business and also public grounds , areas, parks and beaches. Section 4.5.3 .2 Disorderly Conduct Prohibited. A person shall be guilty of disorderly conduct if , with the purpose of causing public danger , j alarm, disorder , nuisance , or if his conduct is likely to cause public danger , alarm, disorder or nuisance , he willfully does any of the following acts in a public place : a. Commits an act in a violent and tumultuous manner toward another whereby that other is placed in danger of his life , limb or health ; b. Commits an act in a violent and tumultuous manner towards another whereby the property of .any person -32-
