BY.-Law 4 . 5 . 1a occurs shall be deemed to <br /> have made , aided , caused, suffered, <br /> I countenanced , or otherwise assisted in the <br /> making of the said improper noises and <br /> shall be punished by a fine of not more. <br /> than $50 . 00 for each offense . <br /> i <br /> Section 4 . 5. 2 Alcoholic Beverages - Minors. . It sha.l1 be <br /> unlawful for any person who has not <br /> attained the age as determined, from time <br /> to time , by the General Court of the <br /> Commonwealth of Massachusetts as being <br /> the lawful age for consumption of <br /> 1 alcohol to consume or knowingly have in <br /> I his or her possession alcoholic beverages <br /> on public highways , including vehicles <br /> thereon , or in public places within the <br /> Tovin of Mashpee . Whoever violates the <br /> provisions of this by-law shall be fined <br /> in an amount not exceeding $50 .00 for <br /> each offense . <br /> Section 4.5. 3 Disorderly Conduct <br /> Section 4.5.3. 1 Definition . "Public Place " shall mean any <br /> place , structure or building to which the <br /> general public has access and a right to <br /> resort for business, entertainment , or <br /> other l avjfu 1 purpose , but does. not <br /> necessarily mean a. place devoted soler to <br /> the uses of the public . It shall also <br /> include the front , parking lot or <br /> i immediate area of any store , shop , <br /> restaurant , tavern , or other place of <br /> business and also public grounds , areas, <br /> parks and beaches. <br /> Section 4.5.3 .2 Disorderly Conduct Prohibited. A person <br /> shall be guilty of disorderly conduct if , with <br /> the purpose of causing public danger , <br /> j alarm, disorder , nuisance , or if his <br /> conduct is likely to cause public danger , <br /> alarm, disorder or nuisance , he willfully <br /> does any of the following acts in a public <br /> place : <br /> a. Commits an act in a violent and <br /> tumultuous manner toward another <br /> whereby that other is placed in <br /> danger of his life , limb or health ; <br /> b. Commits an act in a violent and <br /> tumultuous manner towards another <br /> whereby the property of .any person <br /> -32- <br />
