Prior to the granting of any <br /> such special permit, the Board of <br /> Appeals shall consider comments and <br /> recam,endations fron the Conservation <br /> Commission, the Shellfish Commission, <br /> the Inland and Coastal Waterways Com- <br /> mittee and the Harbormaster. Failure <br /> by any of the aforementioned to camient <br /> may be interpreted as approval of the <br /> proposal. The Board shall not grant the <br /> special permit if the structure will <br /> unduly interfere with free passage of <br /> travel by water or land or cause or <br /> contribute to the substantial disrupt- <br /> ion or degradation, through direct or <br /> indirect impacts, including uses allowed <br /> by said structure, on the marine or coast- <br /> al envirarment. The applicant shall bear <br /> the burden of proof when questions <br /> exist about the proposal's contri- <br /> bution to environmental damage. A vari- <br /> ance up to an additional 25 feet in <br /> length may be permitted by the Board of <br /> Appeals after considering ca cants and <br /> recamrendations by the Conservation <br /> Commission, the Shellfish Commission, <br /> the Inland and Coastal Waterways Cc an- <br /> ittee, and the Harbormaster. Outdoor dining shall be allowed in <br /> commercial districts as an accessory <br /> use to an allowed eating place serv- <br /> ing food and beverage, provided that <br /> visual screening shall be required <br /> in any area abutting a residential <br /> zone.
