organization , the principal purpose of which is the <br /> conservation of open space. The non-profit <br /> organization shall execute a restriction <br /> enforceable by the Town of Mashpee which shall be <br /> recorded at the Barnstable County Registry of Deeds <br /> providing that such land shall be kept in an open <br /> and natural state and shall not be built on for <br /> residential use or developed for accessory uses <br /> such as parking or roadway or any other uses not <br /> allowed by Subsection 9 . 3 in minimum open space <br /> areas . The non-profit organization shall own and <br /> shall maintain the common open space and shall not <br /> dispose of any of the common open space by sale or <br /> otherwise except that said non-profit organization <br /> may offer to convey such open space to the Town of <br /> Mashpee for acceptance by it for park or open space <br /> use . <br /> (c ) Ownership by a corporation or trust - The open <br /> space shall be conveyed to a corporation or trust <br /> owned or to be owned by the owners of the lots or <br /> residential units within the development . <br /> Ownership of the corporation or trust shall pass <br /> with conveyance of the lots or residential units . <br /> The corporation or trust shall execute a <br /> restriction enforceable by the Town of Mashpee <br /> which shall be recorded at the Barnstable County <br /> Registry of Deeds . Said restriction shall provide <br /> that such land shall be kept in an open and natural <br /> state and not be built on for residential use or <br /> developed for accessory uses such as parking or <br /> ,roadway or any other uses not allowed by Section <br /> 9 . 3 in minimum open space areas . The corporation <br /> or trust shall own and maintain the open space and <br /> shall not dispose of any of the open space by sale <br /> or otherwise except that said corporation or trust <br /> may offer to convey such open space to the Town of <br /> Mashpee for acceptance by it for park or open space <br /> use . <br /> 9 . 3 .3 . 5 The developer ' s declaration of his choice of <br /> the three methods described in Subsection 9. 3 .3 .4 above , <br /> shall be included in his application to the Planning <br /> Board for a Special Permit to develop an OSID, along <br /> with the required maps and plans describing the open <br /> space areas and the proposed uses within said areas . <br /> Before final approval of the OSID, or of any definitive <br /> subdivision of land within the OSID, by the Planning <br /> Board , the developer shall also file with the Board a <br /> copy of the covenants and restrictions necessary to <br /> secure the permanent legal existence of the common open <br /> space and a copy of any proposed deed for transfer in <br /> fee to the Town or to . a non-profit organization . <br /> 9 - 6 <br /> Ji <br />
