SECTION 11 : FLOOD PLAIN ZONE PROVISIONS <br /> Permits for new construction , alteration of <br /> structures , or other development (any man-made change to <br /> improved or unimproved real estate , including but not <br /> limited to buildings or other structures , mining , dredging , <br /> filling , grading , paving , excavation or drilling <br /> operations ) , at or below the Base Flood Elevation as <br /> specified within the A and V zones ( in unnumbered A zones , <br /> in the absence of Flood Insurance Administration data , the <br /> base flood elevations shall be determined by obtaining , ' <br /> reviewing and reasonably utilizing any existing - base flood <br /> elevation data from Federal , State or other sources ) as <br /> designated on special F . I . A. Flood Insurance Rate Maps , Page <br /> five and Page ten dated October 19 , 1977 , as amended <br /> (which are on file with the Town Clerk , Planning Board and <br /> Building Inspector ) , shall be approved subject to other laws <br /> and by- laws applicable thereto and to the following : <br /> 1 . New construction or substantial improvement <br /> (repair , construction or alteration containing <br /> 50% or more of the market value of the structure <br /> before improvement , or if damaged , before <br /> damage occurred ) , of residential structures shall <br /> have the lowest floor ( including basement ) , <br /> elevated to not less than base flood elevations . <br /> New construction or substantial improvement of <br /> nonresidential structures shall either be <br /> similarly elevated or , together with attendant <br /> utility and sanitary facilities , be flood <br /> proofed to not less than base elevations . <br /> ( Substantial improvement will have been deemed to <br /> occur when the first alteration of any <br /> structural part of the building commences . ) <br /> 2 . Where flood-proofing is required in accordance with <br /> Section 1 , a registered engineer or architect <br /> shall certify that the flood-proofing methods are <br /> adequate to withstand the flood depths , pressures , <br /> velocities , impact and uplift forces , and other I` <br /> factors associated with the base flood . <br /> 3 . Any new construction or substantial improvement to <br /> be undertaken within said zones shall be in <br /> accordance with the Massachusetts Uniform Building <br /> Code , Section 748.0 as amended . The Building <br /> Inspector shall (a ) review all proposed <br /> development within the flood zones to assure that <br /> all necessary permits which are obtainable at such <br /> time have been received from those governmental <br /> agencies from which approval' is required by <br /> Federal or State law, including Section 404 of the <br /> 11 - 1 <br />
