SECTION 11C : AREAS OF CRITICAL ENVIRONMENTAL CONCERN (ACEC) <br /> 1 . PURPOSE <br /> The purpose of this section is the protect- <br /> ion of areas of Critical Environmental <br /> Concern , areas of significance for flood <br /> control or the prevention of storm damage , <br /> waters containing shellfish and fisheries , <br /> and other public interests identified by <br /> the "Wetlands Protection Act " ( M. G. L. , <br /> Chapter 131 , Sections 40 and 40A and the <br /> Town ' s Wetland Protection By- Laws . <br /> 2 . GEOGRAPHICAL APPLICABILITY <br /> This section shall apply to all areas within <br /> the Waquoit Bay Areas of Critical Environ- <br /> mental Concern (ACEC ) as designated by the <br /> Massachusetts Executive Office of Environ- <br /> mental Affairs on November 26 , 1979 in <br /> accordance with M. G. L. , Chapter 21A, Section <br /> 2 ( 7 ) and to a buffer zone extending <br /> twenty five feet landward from the edge of <br /> the ACEC . For those .lots or land parcels <br /> totally encompassed by the ACEC , this <br /> article ' s applicability will be limited to. <br /> one hundred ( 100 ) feet landward of the edge <br /> of wetlands as defined by M. G. L. , Chapter <br /> 131 , Section 40 . In case of any dispute re- <br /> garding the boundary of the areas defined <br /> under this section , the Conservation <br /> Commission will be consulted making the <br /> final determination based on the best <br /> available data . <br /> 3 . REGULATION OF CONSTRUCTION AND LAND <br /> ALTERATION <br /> ( A ) Within the above-described area , no <br /> construction of dwellings or any other <br /> primary or accessory buildings or <br /> structures , except those permitted <br /> under Section 6 . 3 . I ( 9 ) or Section <br /> 11C . 3 . ( D ) , is permitted . <br /> ( B ) Within the above-described area , no <br /> clear cutting of vegetation or wildlife <br /> habitat , except for a path no more than <br /> twenty ( 20 ) feet wide to provide access <br /> 11 - 25 <br />
