DECISION <br />The dwelling units as shown on the plan sub- <br />mitted conform to the permitted uses allowed <br />under Section 9.53. <br />The height of the proposed sturctures con:crr: <br />to the height restrictions for 1;1 and R2 zon- <br />ing districts as set forth in Section 7. <br />The petitioner has met or exceeded all of the <br />requirements as established in Section 9.5 <br />Zoning By -Laws of the Town of Mashpee and such <br />use of this land would not substantially dero- <br />gate from the main intent of the Zoning Bv-Law. <br />The Board herewith grants to LEISURE VILLAGE - <br />MASSACHUSETTS a Special Permit to construct a <br />Planned Retirement Community as per plans sub <br />mitted to the Appeals Board on April 9, 1974, and <br />on file with the town clerk, with and encluding <br />the following conditions: <br />1. That the initial. recreational facilities <br />be substantially completed prior to issu- <br />ance of a certificate of occupancy for any <br />dwelling unit within the Planned Retirement. <br />Community. <br />2. That an approved central water supply sys- <br />tem or systems and an approved Sanitary <br />Waste water disposal system or systems be <br />provided for in the Planned Retirement Com- <br />munity.
