O'Connell <br />TOWN OF MASSHPEE <br />FACTS <br />The petitioner filed a Special Permit and Variance to construct 96 two bedroom <br />condominium units on 21.79 acres of land located on the northerly aide of <br />Ashumet Road, between Ashumet Road and Route 130. The project land is located <br />in an R-1 zoning district and is bordered on the North by 2.63 acres of <br />industrially zoned land, and to the East by 6.82 acres of commercial 2 zoned <br />land. The land has 1,669.20 foot frontage on Ashumet Road. The project land <br />is triangular in shape and includes an area to the South of Ashumet Road <br />containing 10.97 acres. <br />DECISION <br />The Board feels that the 10.82 acres to the North of Ashumet Road and the <br />10.97 acre parcel to the South of Ashumet Road are not contiguous parcels. <br />Also the Board finds that the requested number of units (96) is considerably <br />above a satisfactory number considering the shape of the project parcel or <br />parcels. In discussing the density problem with the petitioner's representative, <br />it was agreed that the number of units shall be reduced to 64. <br />The Board in granting the Special Permit for 64 condominium units does so with <br />the following restrictions: <br />A. The 2.63 acre industrial parcel may be used only for the well site for <br />water supply. No building shall be allowed on this parcel, nor any future <br />development. The parcel shall be left as a "green area". <br />B. The parcel to the South of Ashumet Road containing 10.97 acres shall remain <br />as a common area. No building shall be allowed on the parcel. The parcel may be <br />used for recreational purposes providing all plans for such are submitted to and <br />accepted by the Board of Appeals, Board of Health, and Building Supertendent. <br />C. The construction of the 64 units shall commence with the issuance of the <br />building permits and no phasing will be required. <br />D. The swimming pool shall be completed during the initial building stages. <br />E. All set back, frontage, and parking requirements shall be based upon <br />current zoning laws of the Town of Mashpee as presented in <br />proposal, a copy of which is filed herewith. <br />Vote: <br />Lawrence - yes <br />Keliinui - yes <br />O'Connell - yes <br />E <br />
