PAGE 2. <br />THE COMMONWEALTH OF MASSACHUSETTS <br />n. <br />TOWN OF MASHPEE <br />BOA RnD OF APPEALS <br />............. une--11..........................19.33.... <br />Decision of the Board of Appeals on the appeal and petition of..... <br />Mr. and Mrs. Andrew Higgins (con't.) <br />..................................................................................................... <br />Objectors to thepetition claimed that the structure was above 35 feet and in excess <br />of the 2-1/2 stories allowed by the By -Law. They feel that the house was <br />aesthetically obnoxious and detrimental to the area. The'Appeals Board concurs with <br />their objections to the height of the structure and has ordered that the aforementioned <br />structural changes be made. (see attached copy B) Concerning the use of the third <br />floor area, which according to plan is the master bedroom, the Board feels that a <br />severe financial andpersonal hardship would be placed on the petitioner if the house was <br />ordered taken down and that because the structural changes were made to conform to the <br />height restrictions, that no outward appearance would be noticeable if the petitioners <br />were allowed to use the third floor area. <br />DECISION <br />1. The Board orders that the structural changes as shown in Copy B (attached) be computed. <br />2. The Board isdues a variance to the ';petitioners for Sec. 2.24 andSec. 2.25 on the <br />grounds that a leteral enforcement of the provisions of the By -Law would create a <br />severe personal and financial hardship and that because the structure will now conform <br />to the height restrictions, no further interior changes would affect the exterior look <br />of the structure; therefore creating no visible detriment to the public good or <br />seriously derogating from the intent of the By -Laws-----,, <br />1/o 7-E : 6/W691V / M ,4 I/; <br />FORM 1095 HOBBS 8 WARREN.
